Nevada Workers' Compensation Specialist
Certified Specialist for Your Work Injury Claim
If you’ve been hurt while working in a Las Vegas casino, construction site, or office, Nevada law is designed to protect you—but the system is a legal "minefield." Navigating the Nevada Industrial Insurance Act, and relater laws and regulations requires more than just an attorney, it requires an expert. At Muslusky Law, our founder Adam Muslusky is recognized by the Nevada State Bar as a Certified Workers’ Compensation Specialist. With over 25 years of experience, we fight the insurance companies and their efforts to "deny, delay, and diminish" your claim and your benefits.
Building Your Claim to Maximize your Health, and then your Recovery
We don't just file paperwork, we also guide with the laws pertinent to the facts of your case. We spot the issues and anticipate the Insurer's actions beforehand to make you aware of what's at stake. Our goal is to get you to the best medical care available while hunting down any and all additional benefits you may be entitled to get.
Navigating the C-Series Forms (C-1 & C-4): We guide you through the critical 7-day window for the C-1 Notice of Injury and ensure your C-4 Claim for Compensation is filed within the strict 90-day deadline. One missed date can end your claim; we make sure that doesn't happen.
Securing Wage Replacement: If you’re taken off work entirely or given light duty restrictions your employer can’t accommodate, we fight to secure your Temporary Total Disability (TTD) benefits. This typically replaces roughly 66.6% of your average monthly wages to help keep your family afloat during recovery.
Managing Medical Treatment & Specialized Care: We ensure you have access to authorized physicians under Nevada’s current provider lists, fighting for authorization for whatever medicine or treatment from therapy all the way to surgery you need to recover your health.
Battling Benefit Denials & Appeals: If your claim is denied or your benefits are interrupted, or terminated, we will fight to recover, or reinstate those benefits all the way to the Nevada Supreme Court, if appropriate. We proactively and aggressively chase down all benefits you may be entitled to on your claim.
Pursuing Third-Party Claims: We are one of the few firms in the State of Nevada which handles both Personal Injury and Workers' Compensation claims. So, if your industrial injury was caused by a Third Party such as faulty machinery or a reckless driver, we also hunt down appropriate insurance policies and pursue the negligence claims when they exist.
The Employer’s Requirements & Your Rights
In Nevada, workers’ compensation was designed as a "no-fault" system. But the actions of the employers and their insurance companies suggest otherwise, often resulting in a "Two-front" war with the injured worker. Whether you were injured in a sudden accident or developed an "industrial condition" like a repetitive motion injury, you are supposed to be covered. However, insurance companies frequently deny claims and/or play games with accepted claims for un represented injured workers. Contact us immediately so you don't miss the many deadlines which could compromise your medical care, recovery and other benefits you're entitled to before it is too late!
Uninsured Employers: If your employer failed to carry the state-mandated insurance, we help you access the Nevada Uninsured Employers’ Account to ensure you aren't left paying for a workplace injury out of pocket.
Protection from Retaliation: Nevada is an "at-will" state, but it is illegal for an employer to fire you solely for filing a workers' compensation claim. That doesn't mean the employer won't try to make your life miserable as an injured worker. We protect your rights from day one.
FAQs About
Workers' Compensation
How long do I have to report a work injury in Nevada?
Under Nevada law, you must report your injury to your employer "as soon as practicable," but strictly within 7 days of the accident — unless you can show the employer had actual notice of your accident.
Can I choose my own doctor for a workers' comp claim?
You must choose a doctor from the list of doctors maintained by the insurer. There's also a lot of bad doctors on those lists. Contact our office immediately about your claim so you don't compromise your medical care by missing a deadline or allowing yourself to be sent to a doctor of the insurance company's own choosing.
How are my weekly wage benefits calculated?
You are entitled to Temporary Total Disability (TTD) benefits equal to 66.6% of your average monthly wage, it is typically calculated from 12 weeks before your industrial accident/exposure all the way up to your full period of employment, capped at one year prior.
